How long does a divorce take in Malaysia?
The timeline varies depending on whether both parties agree and which court handles the matter. An uncontested divorce through the Civil court often takes three to six months. Contested matters or those involving Syariah proceedings can take longer. We outline realistic timelines at your first meeting so you have a clear picture from the start.
What factors does the court consider in custody decisions?
Malaysian courts centre their decisions on the welfare of the child. Judges weigh the child's age, physical and emotional needs, each parent's capacity to provide care, the child's existing routines, and — where appropriate — the child's own wishes. Our role is to present your circumstances clearly and support you in showing how your proposal serves your child's interests.
How is maintenance calculated?
There is no fixed formula in Malaysia, but courts consider both parties' income, the reasonable needs of the child or spouse, any existing financial obligations, and the standard of living during the marriage.
